GENERAL CONTRACTING CONDITIONS

www.kausifans.es (from now on, the Web) is a web site property of Kausi Fans S.L., from now on THE OWNER, with CIF/NIF nº: B88472782 and social address in: C/ Arga, 21, C.P. 28002 - Madrid (Madrid).

The access, reproduction and use of the services of the Web requires the previous acceptance of the Conditions of Use in force at every moment; THE OWNER reserves the right to modify the above mentioned Conditions when he considers it opportune, by means of the publication of the new text in the Web. It is a responsibility of the user to know the Conditions of Use before acceding to the products and services of the Web; in case of not being in agreement with the same ones, we requested to him, abstain from using it.

PROPERTY

The Web is a work composed of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, including html codes of the website, etc.), whose Intellectual Property corresponds to the OWNER, except for those materials obtained under license from third parties.

The OWNER and its licensors retain at all times the Intellectual Property on the Web and on the various elements that make it up, individually considered, in all copies made (whatever the medium to which they are incorporated), granting on them only the rights of use described below. Any right that is not expressly assigned is understood to be reserved.

In addition to the above, THE OWNER is responsible for the selection, design of the structure and layout of the contents of the website, as well as who has taken the initiative and assumed the risk of making the substantial investments aimed at obtaining, digitizing and presenting the same, corresponding, therefore, to the protection that Article 12 and Title VIII of Book II of the Law on Intellectual Property may grant on the website, considered as a database.

The OWNER is also the sole owner of the design and graphic image of the Web, reserving the relevant legal actions that could correspond against people who make imitations or unfair uses of it.

WEB CONTENT AND DOWNLOADS. PERMITTED AND PROHIBITED USES.

It's allowed:

  • Browsing the Web, i.e. access and display of the same on a device, any temporary or accessory reproduction being authorised, provided that it is not voluntary and forms an integral and essential part of the technological process of transmission. Navigation through certain sections of the Web requires prior registration.

  • Benefit (after registration), of the services and advantages provided by the OWNER through the Web to its users, under the conditions that are expressly stated in the various sections.

It is strictly forbidden:

  • Any operations regarding the Web, its contents, the downloaded products and the copies of all of them that are contrary to the Law, good customs and good faith.

  • Any use outside the personal and private sphere, especially those with commercial or professional purposes, including sending advertising or messages and collecting and processing data from third parties.

  • Any type of extraction, public communication and/or transmission, total or partial, by any means, outside the private sphere of permitted use and, especially, its incorporation into any other work, including web pages, collections or databases. Excluded from this prohibition is the publication in the media of the materials that can be downloaded from the Press Room section.

  • The removal, concealment or misrepresentation of the notices and warnings on the Intellectual or Industrial Property of the Web or any of the products provided through it.

  • The operations and activities expressly forbidden in any other section of these General Conditions and, in general, any that may harm the normal operation of the Web, other users or any third party.

LINKS TO THE WEB

  • It is authorized the establishment of links and hyperlinks to the Web from other pages or websites, provided that they are not made in a way that damages the public image and brand of the OWNER, the Web or any of the people and products referred to in it. In the establishment of links to the Web is expressly prohibited the use of techniques that involve confusion about the identity and ownership of content, such as framing or others.

  • It is forbidden to establish links from pages or websites whose content promotes or advocates, directly or indirectly, any type of violence, discrimination, pornography or illegal activity. Likewise, it is expressly forbidden to establish links for commercial purposes.

In the creation of the links is expressly prohibited the use of elements extracted from the Web, without the prior and express consent of the OWNER

In no case may be understood that links to the Web from pages or websites of third parties imply relations of the OWNER with the owners of these, nor does it imply any support, sponsorship or recommendation of the OWNER on them, so that the OWNER is not responsible in any way regarding their content and legality.

CONTENTS AND USER BEHAVIOUR

As a customer or user of the Web, you agree to make appropriate use of the content and services offered through the same and not to use them for:

  1. To engage in activities that are illicit, illegal or contrary to good faith and public order.

  2. Disseminate content or propaganda of a racist, xenophobic or pornographic nature, or that advocates terrorism or that violates human rights.

  3. Cause damage to the physical and logical systems of the OWNER, its suppliers or third parties, introduce or spread in the network computer viruses or any other physical or logical systems that are likely to cause the damage mentioned above.

  4. Disseminate content that undermines the image and reputation of the OWNER or third parties.

  5. Attempt against the rights of Intellectual Property, Industrial, image, honor or others that correspond to the OWNER or third parties.

The OWNER will have full freedom to decide whether the contributions and messages are finally published on the Web or not, being entitled to withdraw them when it deems appropriate.

The violation of any of the rules contained in these Terms of Use and especially, of the provisions of this clause, will empower the OWNER to terminate immediately as a user or subscriber of the Web.

DELIVERY DATES

Delivery time is generally 5 working days from the date of purchase throughout the Iberian Peninsula. However, under special conditions and dates (Christmas, Black Friday...) or exceptional circumstances in which the courier company suffers special stress due to the volume of goods transported this period may be extended in a reasonable manner according to the circumstances.


RIGHT TO WITHDRAW

The customer has 14 calendar days from the receipt of the order to voluntarily withdraw from the purchase, without any penalty and without indicating the reasons. If the consumer or user wishes to withdraw from the purchase of the product or service contract, he or she may use the withdrawal form (which can be found on the following page) to communicate his or her decision to the seller or service provider.

The purchase must be returned with all its products. In any case, for hygiene reasons the products to be returned must be in perfect condition, unused, in their original packaging and seal and with all their accessories.

The customer shall bear the costs of return shipment. No return shipments will be accepted under any circumstances.

The customer will be responsible for ensuring that both the product and its packaging arrive in perfect condition. The items must be packaged appropriately to avoid possible deterioration during transport.

Once we receive the return package, we will verify its condition and as soon as we check that the returned items, as well as any accessories, samples, promotional gifts and documentation, are complete and in perfect condition, we will send the customer an email to notify him/her of the approval or rejection of his/her refund.

The reimbursement of all payments received for the purchase, including delivery costs, will be made within 14 calendar days from the communication of the withdrawal.

The refund will be processed through the same payment method used by the customer for the initial transaction.

We reserve the right to withhold the refund until we have received the products or until the customer has submitted proof of return, depending on which condition is met first.

We will not refund if the product has been used.

LEGAL WARRANTY

In the event that the customer receives a wrong product or one that is in poor condition, or in the event of loss or damage to products by the transport company, the customer may request a return and/or replacement within 14 calendar days of delivery. In this case, we undertake to assume the costs of sending the return, we will collect the defective product and/or replace the missing product with another identical one at no additional cost to the customer.

In general, the legal guarantee of the products is two years from the delivery of the products.

The user or customer has two months to report any non-compliance that may be found in the product. In any case, those stated after the first six months will not be presumed to be manufacturing defects.

WITHDRAWAL FORM

(You should only fill in and send this form if you wish to cancel the contract or service contracted).

FOREIGN EXCHANGE POLICY

To request a product change, the customer must contact customer service within 14 calendar days of receiving the order.

No freight forwarding will be accepted under any circumstances.

In case the product to be exchanged has a higher price than the previously purchased one, the customer must pay the difference in value. If, on the other hand, the new product has a lower price than the previously purchased one, the difference in the amount will not be refunded in cash, but will be made in the form of a gift voucher to be used in your next purchase.

To manage any type of return or exchange of products purchased at www.kausifans.es the customer must contact our Customer Service.

The client must indicate the order number and we will tell him/her exactly how to proceed. We also inform you that we will not accept changes or returns that have not been previously communicated by the indicated means.

CANCELLATIONS

The customer or user may cancel his order, as long as it has not left our warehouses. In such a case, he/she must contact the OWNER by e-mail [email protected] or through the Customer Service channels, communicating his/her identification data and order reference number.

In case of cancellations, the amounts previously paid by the user or client will be returned, through the same means used for the initial transaction.

CUSTOMER SERVICE DEPARTMENT

If the order has not left our warehouse, we will cancel it without any problem, but if the order is already on its way, we will have to wait to receive it back and once we have confirmed the reception of the order, the amount of the product will be refunded minus the shipping costs and the return will be carried out in the same form of payment used in the purchase.

DATA PROTECTION

The information or personal data you provide will be treated in accordance with the Privacy Policy. By using this website, you consent to the processing of such information and data and declare that all information or data provided to us is true and corresponds to reality.

MODIFICATIONS

THE OWNER reserves the right to make, without notice, the changes it deems appropriate in the Web, may change, delete or add both content and services provided through the same, as the way in which they are presented or located.

Although the OWNER will make its best efforts to keep the information contained on the Web updated and free of errors, it does not offer any guarantee regarding its accuracy and updating. Nor is there any guarantee of obtaining any result or specific purpose, so access and use of the Web, is the sole responsibility of users and customers.

LEGAL ACTION

THE OWNER will pursue the breach of these Terms of Use, as well as any misuse of the Web or its contents, infringements of the rights that correspond to it or its licensors, especially those of intellectual property, exercising all actions, civil and criminal, which may correspond in law.

APPLICABLE LAW AND JURISDICTION

For any controversy or conflict that may arise, derived from these terms or conditions, Spanish Law will be applicable. The resolution of legal disputes will be submitted to the jurisdiction of the Courts and Tribunals of the user's or client's domicile.
